Anyone over 18 years of age is eligible to participate in the Fat Loss Challenge (“Challenge”) operated by FITera, FITera Nutrition and Global Fitness Network. (“FITera”).

Each participant must take a side-facing picture and provide a video of themselves taking a waist measurement and a body fat measurement using a Bioelectrical Impedance Analysis scale or body fat caliper. Alternatively participants may have their body fat measured using a Hydrostatic weighing method, a Bodpod (air displacement plethysmograph), a DEXA (Dual-Energy X-Ray Absorptiometry) scan, or a 3D body scan, and submit the certified results. Participants will then submit a second side-facing photo and body fat measurement at the end of the Challenge. Participants may only have one Challenge active at a time.

Participants can start the Challenge any time within 30 days of registration. Participants need to upload their picture and measurement video to this Challenge upload page, and then complete this Start the Challenge! form to provide a name, email, starting fat weight, waist measurement and starting date. The registration fee for the Challenge is $6.95, and is non-refundable.

Participants may end a previous challenge and start a new Challenge by re-submitting their picture and measurement video, and completing the ‘Start the Challenge’ form a second time. Second or future form completions will overwrite your original entries, and the 6-month timeline will restart. Participants may not engage in two or more Challenges at a time, and subsequent Challenges will require new submissions of pictures and body fat measurements.

Participants complete the Challenge by decreasing their body fat by 25lbs, and uploading an ‘after’ pic and measurement video demonstrating the body fat reduction. Participants have 6 months to complete the Challenge. Participants must email Fitera at support@fitera.com within 30 days of uploading their finishing materials and completing the Challenge. Participants who provide finishing submissions more than 6 months from the start date, or send the notification email for Challenge completion more than 30 days after submissions, will not be eligible for a prize.

What’s included in the cash prize (“cash prize”): Up to $500 cash, depending on offer and eligibility at time of registration. After you complete the challenge, notify us that you have chosen the cash prize and we’ll contact you to arrange the payment. We can send the payment via Paypal, bank transfer or by paper check. We will confirm when the payment has been processed, then timelines for receiving the money will depend on the method chosen and your bank.

• i. Winner must be at least 18 years of age at the time of travel.

• ii. The winner will be solely responsible for his/her own transportation to/from the Loreto House, and flights are not included with the Prize. Winner will also be responsible for all other expenditures of the trip including, and without limitation, airport taxes, airport transfers, passport and visa fees, insurance, phone calls, optional excursions, beverages, meals, special needs and services required by guests with disabilities, tips to trip managers, representatives, drivers and local guides, items of a personal nature, and excess baggage.

• iii. Participants can schedule your trip for any time within 2 years of successfully completing the Challenge. Scheduling the Loreto House is subject to availability.

• iv. The Loreto House has two bedrooms, each with a queen-size bed and bathroom, and there is also a queen-size sofa sleeper in the living room. Pets are not allowed, but children are welcome. Children under the age of 3 do not count towards the 5-person total. The Loreto House has one step to enter the main living space, which includes the living room, kitchen, dining room, bedroom and bathroom. The upper floor is not accessible to guests with limited mobility. If guests cannot access the main living space of the Loreto House due to limited mobility, alternative accommodations may be provided at the sole discretion of FITera.

• v. For rescheduling or cancellation, participants can make changes up to 60 days prior to the reserved dates to guarantee being able to select different dates. Within 60 days, re-selecting dates will depending on if the reservation can be refilled. If another client books the dates the original client may book a 7-night stay at another time. If the dates cannot be filled the client loses eligibility for the 7-night stay.

• vi. All travelers are responsible for (1) all travel documents including, without limitation, a current, valid passport or other travel documents acceptable to the airlines, the destination countries, Transportation Security Administration, and the US Government, as they apply, (2) all medical requirements, (3) respecting all local regulations and (4) for full compliance with the regulations of all venues. The Loreto House Prize is non-transferable and has no cash value.

• i. Participant acknowledges and agrees that FITera has no responsibility whatsoever for injuries, losses, or damages of any kind that result from entrance into the Challenge or receipt, acceptance, possession, or use of any prize. FITera recommends that participants visit a primary care physician or similar medical professional to assess and confirm the participants safety in undertaking a Challenge of decreasing body fat by 25lbs.

• ii. FITera maintains no control over the personnel, equipment, or operation of any air, water or surface carrier, ship line, bus or limousine company, transportation company, hotel, restaurant, or other person or entity furnishing service, products, or accommodations as a part of the Prize. FITera shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience, or other irregularity that may be caused or contributed to (1) by wrongful, negligent, or unauthorized act or omission on the part of FITera or any of their agents, servants, employees, or independent contractors, (2) by any defect in or failure of any vehicle, equipment, instrumentality, service, product, or accommodation that is owned, operated, furnished, or otherwise used by FITera, (3) by the wrongful, negligent, or unauthorized act or omission on the part of any other person or entity not an employee of FITera or (4) by any cause, condition, or event whatsoever beyond the control of FITera.

• iii. FITera reserves the right to cancel the Challenge at any time if the integrity of the Challenge is, in FITera’s sole and absolute discretion, compromised in any way. By entering the Challenge, participants release and hold FITera harmless from and against any and all damages and claims of any kind in connection with the Challenge or resulting from entrance in the Challenge, or receipt, acceptance, possession or use of any prize. FITera reserves the right to substitute a prize for an alternative prize of equal or greater value in FITera’s sole and absolute discretion. FITera reserves the right, at their sole discretion, to cancel or suspend the Challenge should cause beyond the reasonable control of the FITera corrupt the security or proper administration of the Challenge. Any attempt to deliberately damage the legitimate operation of this Challenge is a violation of criminal and civil laws, and should such an attempt be made, FITera reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, this Challenge or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Oregon, County of Clackamas. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of FITera in connection with the Challenge, shall be governed by, and construed in accordance with, the laws of State of Oregon, County of Clackamas, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than State of Oregon, County of Clackamas.
